Le procès Pistorius a repris, pour déterminer sa peine

Oscar Pistorius ira-t-il en prison ? Reconnu non coupable de meurtre mais seulement coupable d'homicide involontaire pour avoir abattu sa petite amie en 2013, il est de nouveau lundi au tribunal où sa défense va tenter d'arracher la peine la plus légère possible.

L'audience doit durer plusieurs jours, durant lesquels la défense comme l'accusation peuvent convoquer à la barre des témoins, pour tenter d'emporter la conviction de la juge Masipa.

Lundi matin, le premier témoin appelé a été la psychologue Lore Hartzenberg, citée par la défense.

Pistorius, en costume sombre et cravate noir comme à l'accoutumée, s'est installé calmement dans son box.

Dans la salle, son manager Pete van Zyl et son coach Ampie Louw avaient pris place aux côtés de son père Henke et de son oncle Carl.

Star du handisport mondial, le champion paralympique sud-africain a passé en tout et pour tout huit jours en détention au commissariat à Pretoria après le drame, le 14 février 2013. Il est en liberté sous caution depuis.

Incarcération, prison avec sursis, arrêts domiciliaires, simple amende: toute la gamme des sanctions est envisageable, et Pistorius a peut-être une chance de ne pas être emprisonné du tout. Le code pénal sud-africain ne prévoit aucune peine automatique pour homicide involontaire.

Selon la jurisprudence, d'autres facteurs pourraient interférer: les remords exprimés par l'athlète âgé de 27 ans, son casier judiciaire vierge, la nécessité ou non de le maintenir derrière des barreaux pour protéger d'autres vies humaines.

La juge pourrait aussi entendre la famille de Reeva Steenkamp, la jeune mannequin tuée par Pistorius, si elle vient témoigner, comme c'est la pratique avant la sentence en Afrique du Sud.

Interrogé sur ce point par l'AFP, le parquet n'a pas souhaité confirmer ni démentir.

Un verdict surprenant

Dans un verdict choc rendu le 12 septembre qui a surpris une partie du monde judiciaire sud-africain et profondément meurtri les Steenkamp, la juge Masipa a conclu que Pistorius n'était pas coupable de meurtre mais d'homicide par imprudence.

Le jeune homme a toujours affirmé avoir ouvert le feu par erreur sur la porte fermée des WC pour neutraliser ce qu'il croyait être un cambrioleur, après avoir entendu un bruit suspect.

Le parquet pourrait faire appel mais dans l'immédiat, la juge a considéré qu'il n'avait pas apporté durant le procès, retransmis de bout en bout à la télévision, la démonstration que le sportif avait une intention homicide.

Motif de gloire nationale pendant des années en Afrique en Sud, alliant le glamour d'un sourire de play-boy à une réussite sportive hors norme, le nom d'Oscar Pistorius est désormais associé aux travers du système pénal de son pays.

Personne ne conteste que la juge ait eu raison d'écarter la préméditation.

Et personne n'a trouvé à redire quand elle a refusé de conclure à une dispute de couple sur la base de vieux textos, ou du témoignage de voisins réveillés dans la nuit par des cris et des coups de feu mais n'ayant rien vu.

Beaucoup refusent néanmoins d'admettre que Pistorius n'ait pas mesuré les conséquences de son geste et la possibilité de tuer, sinon Reeva, du moins le cambrioleur qu'il croyait affronter, en tirant quatre fois à balles expansives.

"L'impression que ça donne, c'est qu'on est trop clément", a commenté l'avocat Martin Hood. "On répète ça sans arrêt. On a des magistrats et des juges qui peuvent infliger des peines sévères, et ils ne le font pas (...) Fondamentalement, il manque dans ce pays une culture de la punition et de la responsabilité".

Selon lui, les juges sont influencés par le fait que les prisons sud-africaines sont déjà surpeuplées (9e rang mondial) et sous pression à cause des détentions provisoires. Beaucoup de détenus sont trop pauvres pour payer une libération sous caution ou ne peuvent pas donner d'adresse car ils habitent en bidonville.

Sextuple médaillé d'or chez les handicapés, élu parmi les 100 personnalités de l'année 2012 par le magazine américain Time, Pistorius avait atteint la célébrité mondiale aux Jeux Olympiques de Londres en s'alignant sur 400 mètres a côté des coureurs valides.
