Le procès des auteurs présumés du viol collectif et du meurtre d'une jeune étudiante de 23 ans dans un autobus à la mi-décembre, en Inde, s'ouvre jeudi dans un tribunal du sud de la capitale, New Delhi, avec la présentation d'un rapport de police de 1000 pages.

Cinq hommes, qui vivent pour la plupart dans des bidonvilles de Delhi, seront jugés pour le viol et le meurtre de la jeune femme. Le sixième suspect, qui serait âgé de 17 ans, devrait être traduit devant un tribunal de la jeunesse, mais des examens osseux sont en cours pour confirmer son âge.

Tous les avocats rattachés à ce tribunal ont déjà annoncé qu'ils refusaient de défendre les six accusés pour assurer une « justice rapide », jugeant qu'il serait immoral de ne pas rester à l'écart. Les avocats des suspects ont donc été commis d'office.

Le rapport de police, qui repose sur le témoignage du petit ami de la victime, sera présenté en preuve au procès. Le magistrat prendra acte du document, puis en donnera une copie à tous les accusés, qui doivent obligatoirement se présenter devant le juge.

Selon les informations recueillies par les enquêteurs, les violeurs auraient jeté leur victime et son petit ami hors de l'autobus après l'agression et ils auraient tenté d'écraser la jeune femme. Cette dernière aurait mordu trois de ses agresseurs au cours du viol, tandis que son petit ami aurait été battu à coup de barre de fer.

L'intervention de son petit ami, qui a réussi à la mettre hors de portée de l'autobus, lui a sauvé la vie, jusqu'à ce qu'elle succombe à ses blessures, le 29 décembre.

Le ministre de l'Intérieur, Sushikumar Shinde, a déjà indiqué que les six accusés du viol collectif encouraient la peine de mort s'ils étaient jugés coupables. Le père de la jeune étudiante - dont l'identité n'a pas été révélée en vertu de la loi indienne - souhaite quant à lui que les auteurs de l'agression soient condamnés à la pendaison et qu'une nouvelle loi sur les crimes sexuels porte le nom de sa fille.

La nature extrêmement violente de l'agression a provoqué une vague de colère dans le pays et des citoyens scandalisés sont descendus dans les rues pour réclamer du gouvernement qu'il assure davantage la sécurité des femmes.

En réaction, le premier ministre s'est d'ailleurs engagé à alourdir les peines prévues pour les auteurs de crimes sexuels.

Parallèlement au procès des accusés, la Cour suprême du pays entendra jeudi une administratrice gouvernementale à la retraite, Pernilla Shanker, qui demande au tribunal de suspendre tous les élus des assemblées fédérales et régionales qui font face à des accusations de crimes contre les femmes.

Mme Shanker souhaite également que la plus haute cour de justice du pays force le gouvernement à faire traiter en priorité les milliers de dossiers de viol qui traînent devant les tribunaux depuis des années.
